If you installl the scratched disc it won't but if you install a working one (from a friend) it will let you play the scratched one. :)

The Xbox 360 was designed to perform in either position, the only problem with standing the xbox up is you are risking it falling over. If the xbox 360 is turned on with a game inside and the game disc is spining, if it were to be knocked over the game will be scratched and possibly have permanent damage. I have personally witnessed this on two ocassions and 1 disc was damaged beyond repair
