Generally, Food isn't taxed, but meals are. But the lines may be hard to understand. Sometimes it's just more how it's provided than what it is. It gets crazy, and is absolutely true that a prepared sandwich sitting in the cooler at the deli at your local grocer isn't taxed (it's considered food), but ask for that exact same thing at the deli counter and have it made, and it is! And buy 1 bagel and it's taxable (meal) more than 6 and it's not taxed as food. Candy is taxable...but sometimes it is a food....the lines get murky. (Marshmellow is candy, marshmellow as a pie filling is a food). I can go on & on with this one.....but you get the idea. The retailer normally knows how he has to do it....and there really isn't any reason for him to mess around...the way his responsibility and audits/checks by the State on this go...if he is wrong...it costs him. (If he charges tax when he shouldn't he still owes it, and if he doesn't charge tax when he should, he owes it).
