You have to accept that it was your husband that broke the marriage vows. In my opinion, the BEST way to get back at her is to take HIM to the cleaners in the divorce. Basically, the other guy is trying to make money out of it, but facts are on your side. Talk to your lawyer and make your case. It should be a very strong one, especially since the suit is a) brought after a long time; this would not be the case if something had actually happened, b) if the other party did not have insurance, then they are already partly at fault since they should not have been driving, and c) if possible, the other driver is at fault for the crash or at least had some part in it.
