When the summons was received you should have been given instruction on how to answer. It is VERY important when being sued, the defendent files for all the exemptions allowable under state laws. If you are a homeowner you need to find out if the homestead exemption is automatic or if not, you need to file one. There are many other exemptions, including vehicles, personal property, pension monies, head of household wages, etc. It is advisable whenever being sued to obtain legal counsel if possible.

Can Wages be garnished over a 1200.00 Credit Card Debt?

It is not going to happen. There is a process that these companies follow. They would first put it into collections, then sell it to a collection agency. That is way to low for even a collection agency to take you to court. The original creditor will just write it off. You have nothing to worry about unless you get a summons to go to court, which I gurantee that will not happen.

Does the creditor or the collection agency get the money you pay on a debt?

When a collection agency takes on a bad debt, in many cases they are "puchasing" the debt from the original creditor. When you then pay off the collection agency, your money will stay with that collection agency. This is the most common scenario, but some companies do have their own internal collection agencies (Capital One, for example, has their own collection subsidiary in Idaho - the Westmoreland Agency). Hope this helps!

Once a debt is given to a collection agency can you get the creditor to take it out of the creditor's hands?

Once a debt is handed over to a collection agency, it's typically out of the original creditor's hands. However, it may be possible to negotiate with the creditor to recall the debt from the collection agency, but this process can be challenging and may require convincing the creditor of your ability to repay the debt directly. It's advisable to communicate directly with both the creditor and the collection agency to explore your options and find a resolution.

If you don't receive a summons or any documentation regarding a pending lawsuit by a collection agency how do you know if it's really true?

If you are being sued, you will always receive a summons. Sometimes it is delivered by a process server sometimes by registered mail. A collection agency telling you, you are being sued, does not necessarily make it fact. Only attorneys can file suit and they have to adhere to the state laws where the person resides. A collection agency cannot sue you regardless of what they claim. Sorry, I should add you need to be aware of the difference in collection agency and collection attorney. For instance Mann-Bracken LLC, are collection attorneys and/or arbitrators. They can initiate a lawsuit.
