Oh please! Are you saying he didn't speak to you with all the respect and concern you feel is deserved? And how much is deserved for someone who apparently asked for a loan, swore all over that you would pay it on time, exactly in a certain way, and even probably has mention of what will happen if you don't, etc., and then you failed to do anything you promised. Probably (as it was then repossed quickly) not only without warning, but letting it go until it was desperate. All the while likely causing him tremendous effort and worry trying and recover some of his loss. Well, gee - maybe he was rude - no talk was needed - just payment...or were you trying to make excuses then and looking for another now? Consider...the honorable thing to do would be to pay this businessman for any damages you may have caused him - and then when you actually have done what you said...YOU say thank you to him. He doesn't owe you. Otherwise, do whatever you think you should...but I'll bet that is feel it's OK to not pay or adhere to the agreement you made with him! You can really show him.... I guess you'll take your business elsewhere where it's appreciated and won't ask him for money again.

Can you default on a car loan when the lender stops your automatic payments?

Assuming they haven't actually repossessed the car yet, you should contact them immediately to find out what's going on and begin making up the missed payments. If they made an error, they should stop repossession proceedings and remove the ding on your credit report (you should probably also contact the credit bureaus in the meantime to dispute the report). If they HAVE repossessed the car...If the lender stopped processing your automatic payments without notifying you, and you did in fact have the funds available to make the payments had they tried to process the automatic payments, then you might want to consult an attorney; it sounds like you probably have a case against the lender. If they did notify you that they would no longer be accepting automatic payments, or if they notified you of a failed attempt which you would need to pay manually and you didn't bother to do it, then it's a lot more obviously your fault instead of theirs and there's not going to be much you can do about it.

After your repossessed car is auctioned how long do you have to pay off what you still owe?

BAD news. They have already tried to let you make payments. This time they will want ALL of it.

Are the payments due after repossession the actual car notes or can you negotiate a payment in the state of Maryland?

You can make an offer in any state. Its up to the lender to accept or reject it. Has the lender tried to work with you on payments already and it didnt work out?At this state of the game, the lender wants more than promises. They want MONEY NOW. The more the better. They can get 25% of your disposable income by garnishment so why would they settle for less in an offer? Its time to get serious about paying this debt. Good Luck

Can i get get the name back on my property from an investor that bought my property with a subject to the mortgage and they have stopped making the payments i have tried to contact them but can't.?

You cannot "get your name back on the property" unless the investor conveys the property back to you by deed. If you did not notify your bank of the transfer you should contact an attorney to determine your exposure and negotiate for you with the lender.

How bad is it for your credit to have a leased car voluntarily repossessed?

My car is about to be repossessed. I spoke to the lender who has the second mortgage on our house concerning how bad this would be on my credit report. This particular lender is CitiFinancial. I was told that car payments are not looked at as crucially as credit cards, rent or mortgage payments, and utility bills. If I get my mortgage payments in on time and pay my credit cards down within two years, then I can probably buy just about anything because it will look like the car payments were indeed too high at the time and getting rid of them helped me to get back on track. She said when they are processing a mortgage, car payments are the last thing they look at because people change cars every two to three years and those payments change with the car. She said there is also the possibility of an accident where the car is totaled and ends up being paid off by insurance. There are just too many variables with cars, so they don't pay a lot of attention to the payment pattern or lack of it. first of all being told by a lender that car payments are not looked at as crucially as credit cards, rent or mortgage payments, and utility bills. Is totally NOT TRUE.....Your lender is feeding you with lies. My husband has a repo on his credit record and he voluntarily gave the car back thinking the same thing. And Boy was he wrong. 3 years later and he still cant get a car loan, house loan, credit card loan.... his credit is shot just because of the darn repo. We have tried everything. Finance Co. look at all parts of your credit when going for a loan. and a big part of it is if you have paid your car payment on time... My advice to you is try very hard not toget a repo voluntary or not.... the word "repo" on your credit is not just looked over. Its a big mark that stands-out reguardless how long ago, or if the payments were too high. Any repo is bad.

Can the finance company sue you for the whole amount of the loan if they have the repossessed property and have not sold it yet?

It may depend on how long they have tried to sell it for. They may or may not be able to. I suggest you contact a lawyer in this field and ask it should be free for this.

How do you get child support from a tax refund?

When you claim that your ex is behind in payments, the support enforcement agency will get permission to get any arrears from your ex's tax return, this is after they have already tried to get payments from them and could not.

You purchased a car with your husband as joint signer He left taking car Is not making payments Is hiding You want car repoed. If lender cannot find car to repo what could be the consequences?

Wow...it's good to know I am not the only one! I co-signed for a truck and we got divorce. He was awarded the truck and was to put it in his name. He never even attempted to get a car loan in his name! He did not make payments and they repo'd the truck. They could not find it and since my name was on the loan (lease) first they called me. I actually tried to help them located the truck. Finally, after 4 months they got him. Trust me, they will find him!
