words and actions that lead to a fight, and that you did everything you possibly could to avoid a fight.

3. You must be able to prove that you had no avenue of escape so as to avoid a confrontation. And

4. Bring any witnesses to court with you who can truthfully collaborate your account of things.

Additional: You must also be able to prove that you used no more force than was necessary to thwart the attack (i.e.: no retaliatory violence).

Also: In some states the entire situation may depend on the laws of your state. In several states - if you are in a place that you have a lawful right to be, you have no duty under the law to retreat from an unprovoked attack upon your person.
