I think the most important thing, is that there IS no consistent "legal definition" of sex or gender, in almost any jurisdiction. The primary things that are associated with this are: 1. Primary legal id. In the USA this is a drivers license or non-drvers have an identity card. In the UK, this is the birth certificate. 2. Local jursidction specifics A. in California , the drivers license can be updated with a "DMV" form, if the person has a letter from their doctor. B. in almost every state of the USA, this can be changed w/ a "Court Ordered Name change". This also differs a lot depending on the specific judge you might deal with. C. Federal versus state regulations. In the USA, this is mainly the social security record. So, a more specific question that can be answered is: Is it possible for a pre-op trans-girl to get her Driver's license and Social security records changed from M to F. Possible? yes Easy,no The usual ways involve getting a orchiectomy(castration) getting a court ordered name change, and being very believable and convincing when dealing with specific clerks. I have had one friend tell me that when SHE did it all she just pretended it was all a little typo, and could they fix that up please. At the opposite end. A born woman in South Africa, DID get her legal id done with a typo, and tried to get that fixed and was told that she would have to have a official letter from her sex change surgeon. Crazy huh? So,the big deal, is that it is very inconsistent from one jurisdiction to the next.

A persons legal recognition with regards to gender is not related to whether or not they are pre-op, post-op, or in fact do not intend to undergo any surgery at all. In order for a persons legal gender to be altered from that they were assigned at birth, they require a gender recognition certificate for which the specifications are that they must have been living in their chosen gender role full time for a given period of time (i believe this is 2-3 years), and that they must be over 18 years of age. There is no requirement for any physical transition to have begun.

Thus, a person is legally considered to be of their physical birth gender unless they have a gender recognition certificate to state otherwise. In many states in the US, once a person has had SRS surgery, that person may have their birth certificate and ID card altered to reflect their identified gender. Some states allow legal gender to be altered without surgery, while others do not allow it at all.
