In the state of Texas, a process server will exercise "due diligence" in service, and if that is impossible, they will notify the Court. You also publish your intent to divorce in the newspaper where you believe the other party resides to give them a chance to respond. After all your attempts, if the other party still doesn't respond, the Court will issue a divorce decree... even without them there.

Their absence from the process doesn't stop anything, it just means the court will grant you what you're asking for and you don't have to argue with the other party. It's called a "Default Judgement".

Yes. There are procedures to follow in attempt to serve notice. If the spouse can not be found or is uncooperative, and, as you say, all reasonable attempts made, then the noticed is published in the local newspaper, and you move forward without him. The terms, conditions and distribution of marital assets, if supported should be considered uncontested. You're going to have some roadblocks in getting hold of your share of the assets, but your attorney will tell you what you can do and how. Good luck!

If the court has sealed a divorce decree then you must petition the court to unseal it for you. Could an inmate request a divorce and get one even if his wife denies it?

A person cannot be denied a divorce, but the terms of the divorce can be contested which sometimes leads to a long and lengthy court battle. When a spouse is served with a dissolution of marriage summons and fails to respond the spouse seeking the divorce may petition the court for a motion of default. A judge will review the petition to be certain everything is in order, the judge may also choose to interview the filing spouse. After the judge is satisfied that proper procedures have been followed the divorce will be granted by default. The non-responsive spouse will be notified that the divorce has been granted and that they have forfeited their legal rights to contest any of the terms that were included in the original dissolution of marriage petition. These procedures apply whether a spouse is incarcerated, residing in another state or living outside the country. Be advised, a divorce granted by default does not relieve a spouse of the obligation of child support, that is a different issue.

How do you get a divorce from your wife if she was deported and have not heard from her in a year?

Hire a lawyer. Go to court and get a divorce based on one year separation. Either the requesting party or his or her legal representative can file a petition for the dissolution of the marriage in the state circuit court in the county where the petitioner lives. In cases of absentee spouses a divorce can be granted under the default laws of the state in which it is filed. The court will require the petitioner to prove that they have made a reasonable attempt to locate the absentee spouse before the judge will consider granting the divorce decree.

File the divorce papers have them served on the spouse. If there is no response within the required time limit file a request for the divorce to be granted under the state default laws.
