A police officer has 72 hours to execute a search warrant. ADDED: It can depend upon the jurisdiction and the court's order. No 'open-ended' search warrants are ever issued, but there may be exigent circumstances under which a warrant may not be served until the circumstances are 'right' (e.g.- the contraband had not yet arrived or returned - the activity (whatever it is) only occurs sporadically and at irregular intervals - etc.).

Law Enforcement does NOT ISSUE Search Warrants. Search warrants are issued by judges, after law enforcement has made application for them by means of an 'affidavit.' Unless the judge puts a time limit restriction on the warrant he issues, it can be held for service until the situation (whatever it may be) is right for it to be activated (i.e.: a known drug house, but drugs are not present ALL the time - Someone dealing in stolen property but does not have stolen property on the premises ALL the time - etc.).

Can a police officer search your home with a failure to appear warrant?

Can police start searching through stuff before they serve a search warrant?

Yes and no. If the Police have a search warrant or your consent, they may search you. If they have neither and you're not under arrest, then no. This would be a 4th amendment violation and any evidence obtained through the illegal search would be suppressed. They may only search you incident to arrest, which means after they've verbally informed you that you're under arrest.

When police conduct a search of your home aren't you allowed to be witness to the search?

No. You can be present in the house, but you cannot follow them around as they conduct their activities. As a matter of fact, you don't even have to be home when they serve the warrant.

Do the officer need to show the warrant?

No, if law enforcement officers reasonably believe that a valid warrant has been issued, the officers may begin the search. The warrant does not have to be with them, and the warrant does not have to be given to the owner.

What are your rights when police search your house?

It depends on what is stipulated in the warrant. You can ask to see the warrant and read it over carefully to understand what is allowed and what is not. Your best bet is contacting a criminal defense attorney.Added: The last sentence above is good advice - IFyou are looking for advice IN ADVANCE of the fact. At the time the police arrive to serve the warrant, they are NOT going to await the arrival of your attorney before they execute the warrant.

Does a police officer need a search warrant to enter my house?

Depends on the situation. If the police feel there is a need for emergency action or there is a life-threatening situation in the house then the police don't need a search warrant, they also have probable cause at their disposal.

How many times will the police come to your home to serve a warrant if they don't find you there?

As often as they want until the warrant is taken care of.

How do I find out if I have a search warrant?

If the warrant is actually being "served" on you then it's probably in your best interests not to resist its service. Afterwards you can determine if it was valid or not by contacting the Clerk of The Court, from which the warrant was issued to determine if it is on file, or not.

Can a city police officer serve warrant out of city?

You can serve a search warrant anytime after it is issued by a judge. Sometimes time is of the essence, other times the serving agency may want to wait until certain conditions are just right.
