A mechanic working on a break mechanism (or any sub system) has a duty of care to ensure that the mechanism on which he is working is fit for use. I would have thought that the state of /adjustment of the break calipers would certainly be part of this care. If the calipers were faulty, then at the very least this would have to be reported to the owner/driver and one may perhaps reasonably expect these to be adjusted/fixed as part of a break job.
