At this point the answer is a qualified no. The wording in the Highway Traffic Act (HTA)reads, "Alternating highbeams on other [non-emergency ] vehicles prohibited (2) No person shall use highbeam headlamps that produce alternating flashes of white light on any vehicle other than a vehicle referred to in subsection (1). R.S.O. 1990, c. H.8, s. 169 (2)." Subsection 169 (2) allows emergency vehicles when responding to life threatening emergencies. With that said in the strictest sense of the law, on a motorcycle using a high/low beam pulse, is not the same as what the HTA reads. However, because Canadian courts STRONGLY favor the police interpretation of the act no matter how erronious the local police are in their beliefs, without searching and finding a precident, you will likely lose should a Cop pull you over for having them "pulse". With that said, I am looking at challenging the law Spring 2010 due in part to the loose interpretation of flashes verses alternating pulses, and also in part due to, my right to safe travel supperseeds the loose interpretation of the act. If anyone knows a jurisdiction in Southeast Manintoba or Northwest Ontario who has a traffic court that is ballanced and does not favor cops over defendents please write me with details ffcanadadayparade@remove_this@shaw.ca as I need a jurisdiction with a fair magistrate in order to challange the law and set precedent.

The big question now is, do modulated headlights just warn drivers that you are coming down the road.........or do they INCORRECTLY suggest to them that they may turn in front of you...as in, I'm flashing to say that it's OK to turn. And THIS, as you know if you ride a bike, is the deadliest interaction between cars and motorcycles at intersections!
