Article 1, Section 8 gives Congress the power to call forth the militia and to provide for arming, organizing and disciplining the militia. It does not specifically refer to Congress "keeping" the militia as it keeps a standing army.

Unless you are a convicted felon then it is one of your first amendment rights in the United States. Actually this is a right guaranteed under the second amendment to the constitution of the United States not the first. The United States needed a constitution to abide by. They needed laws to make sure that they keep their promise for freedom.
