The law looks at marriage as a partnership contract and if one does not wish to remain in the contract any more (divorce) then they do not have to. This holds true whether or not the other spouse is present or wishes to stay in the marriage. That being said, divorces in other countries must conform with the laws of that country and courts do prefer to at least have the signature of the other spouse and you will be required to at least make attempts at giving him notice.
