Minors do not choose a guardian or anyone with whom they wish to live with the exception of parental custodial issues. If a minor is having family difficulties and believe they are in a neglectful and/or abusive situation they should contact the state's division of family services for assistance. A person who wishes to be appointed guardian of a minor must be an acceptable adult in the eyes of the court and must qualify under the laws of the state. Unless the guardian is court appointed for the previously cited reasons, the person requesting the action is responsible to pay all court fees and legal expenses, the average cost for a guardianship procedure is $3,500. Some states have established laws for a person who is at least 16-years of age to apply for emancipation rights. Such a procedure is lengthy and the minor must pay applicable court and legal fees themselves. The average court costs is $250-$300 plus any added legal fees if legal representation is required. There seems to be a misconception that emancipation is a simple and sure thing, it isn't. The reality is, emancipation is seldom granted to a minor and when it is done, the court reserves the right to withdraw the decree at any time.
