The children can give their opinion as to whom they wish to live with, although it is frowned upon by many when a judge asks children to give such an opinion as it creates a feeling in the child that they are betraying the parent. It is ultimately the decision of the family court judge, who must weigh the evidence and decide the division and type of custody granted to each parent. Of course, many other factors add into the decision, such as abuse issues (if present), stable living situation, financial situation, etc. Basically, child's opinion matters, but is not the ultimate deciding factor as to custody.

No, that determination is made by the court determined by an objective opinion in what would be in the best interests of the child. Some parents opt for joint custody with the child spending as close to as amount of equal time with each parent as is possible.

When the child reaches the age of majority where they reside (in the USA this may be minimum age of 18 or as high as 21 depending), the child may make that determination on their own without parental permission or court order.

However the child is always free to make their wishes known to the judge, either in court when custody/visitation is being decided or request a modification to the original order by requesting a meeting with the judge, writing a letter to the judge expressing their wishes, or engaging an attorney or guardian ad litem to speak for them. The judge will take into consideration the wishes of the child, and generally, the older the child, the more weight is given to those wishes.

Ultimately, however, the judge will rule depending on what he or she feels would be in the best interests of the child.

everyones opinion is different and some people may argue that children can not choose however in my opnion children have the right to choose who to live with.
