It's up to the officer. If he thinks it's the drivers' fault, then yes he will charge the driver.

Added: Officers on the scene investigating a traffic accident can only issue a ticket to the operator of the vehilce who they determine was At Fault. Their job is NOT to decide whether your story is true or not. . . that's what court and judges are for. If that is your defense, go to court and tell the judge. Taking the so-called "friend" with you and having them testify to what they did might convicne the judge, but the fact of the matter is this: Like the Captain of a ship, the driver is legally assumed to be in control of their vehicle andits passengers at all times.
