The only way your bank account can be garnished--is if there is an court order. If they took you to court and receive a judgment against you, yes they can garnish your wages. Also, if you were summon to court but did not show up, it will be judgment by default and your wages and bank account can be garnised.

A creditor must take a consumer to court in order to begin the legal process to garnish wages. The exact procedure for this process depends upon state laws. Most statutes require the plaintiff in a court case to make a reasonable effort to contact the defendant. This can entail sending a written notice to a last known address. Thus, it is possible to have a default judgment granted against you without your knowledge.

Can a credit card company garnish your wages without going through a court?

No. A creditor who hires a law firm that is licensed to do arbitration (such as Mann-Bracken Attorneys At Law) can circumvent the normal lawsuit process and have the account ruled on by the arbitration board. However, even using the arbitration process the creditor will need to file in the appropriate court in the state where the debtor resides to have a judgment entered. The ways in which the judgment can be executed against the debtor's property depends upon the laws of the debtor's state.

With a judgment and execution, the sheriff can. Without it no. But the collection agency can never legally access it. However, there are ways to do it illegally. Can the creditor do it... ? If you have a citizens acct and a debt with them, then yes, they can legally access whatever accounts you have with them. But a creditor can't just get access to you bank accounts. What are the effects of release by the guarantor without the consent of creditor?

When a guarantor is released without the creditor's consent, it may jeopardize the creditor's ability to collect on the debt if the primary borrower defaults. The creditor may lose the guarantee provided by the guarantor, who may no longer be obligated to fulfill their obligations. This could lead to increased risk for the creditor and may impact the terms of the loan or credit agreement.

A credit card I had has been referred for collection. I set up a monthly payment arrangement which I defaulted on. They are offering me a settlement but it needs to be paid by a credit card today. If not today, they want to garnish my wages. Can they?

Garnishment is a last resort of creditors and in most cases cannot happen overnight. The garnishment process has to be brought before a judge and he or she has to agree to its implementation. A creditor cannot garnish your wages without first giving you notice. The amount of lead time and the exact process vary from state to state.
