What can be done about a 12 year old daughter who you have joint custody of but father has physical custody of tells you she is afraid of her father and DCS wont step in and do anything about it in TN?

I am assuming you mean you both have custody, but your daughter lives with her father most of the time. Joint custody is just that ... you each get a chance to be with your daughter. I suggest you get the story straight as to why your daughter does not want to see her father. Divorce is very hard on children as I am sure you know, and they can "act out." If house rules are set by one or both parents, even 12 year old can feel "put upon" and become very dramatic about it all. According to young children of this age and even into their teens some don't feel they have to abide by any house rules. Then the trouble starts. Be clear as to why your daughter doesn't want to see her father. Sit down with her and have a good discussion and go from there. If you feel your daughter has good reason for not wanting to stay with her father then I suggest you see a lawyer and (legal aid will help if you are living on a small income) and fight for sole custody through the court system. Be sure you have that talk with your daughter and get the facts, because changing custody can be a long and grueling process for both parents and tough on your daughter. If you still can't get anywhere through this process, then I suggest (only if you can prove any allegations such as physical abuse or sexual abuse) through the media. The media can be a pain in the butt at times, but there is the good side to it as well. Beware if you go through the media, because your life won't be your own and you could be dragged through a media circus or word could leak out to family and friends, and it could also be tough on your daughter as school.

Can mother lose custody to father if child fails in school?

Yes. This has happened to my cousin.

If the mother has the custody and father has visitation rights does the mother have the right to deny father to call her daughter at appropriate time?

If you are a good mother I wouldn't DENY the father anything. I think you should set time limits as in do not call after8:30pm on school nights and 10-11pm on the weekends. I don't think it is fair to the child to deny the father the right to speak to his daughter. It will only hurt her in the end.

Can father let child miss school without mothers permission?

It depends on the law where you live and your custody order. If the father has sole legal custody (as opposed to physical custody) he would be able to make that decision without input from the mother. If legal custody is joint or the mother has sole legal custody, no he could not.

Our VA custody agreement says we share legal and physical custody and the children shall reside with the mother for school purposes. The father has weekly visitation. Who is the legal custodial parent?

Both of you are legal custodial parents. Neither parent has greater costodial rights that the other one.

What is the probability of the father getting full custody of his children?

Many men take an active role in raising their children. If the father was the primary caregiver then he should be considered for primary physical custody since caregiving should be one of the the main qualifications for awarding physical custody along with health, safety and stability. The father would need to convince the judge that the children would be better off with him. That may mean providing evidence to the court that the mother is unfit to have custody. It is extremely important for the father to have a lawyer who specializes in custody issues.Judges know that generally speaking, mothers are the ones who provide the day to day care for their children, even if they also work outside the home. You need to be able to show that you provided much of the day to day care for your children including such tasks as the following:You fed, bathed and put the child to bed.You got the child ready for school, packed their lunch and got them to school or to the bus.You attended all the school conferences, plays, etc.You brought the child to the doctor and dentist visits and stayed home with them when they were sick. You brought them to school events, sports, birthday parties, play dates, extra curricular activities. You took the child shopping for clothes.

What factors are considered in a case involving child custody?

The reality is that generally, mothers are favored for primary physical custody. The reason is the other reality that mothers provide more nurturing care and are generally the primary caregivers for young children. That doesn't mean that fathers don't get custody because many do. If the parties are presently in the process of divorce an experienced attorney is essential because the case will need to be carefully prepared and experience in the particular court where the hearing will be held is extremely valuable. The judge must have convincing evidence that father having custody is in the best interest of the children. The court will consider the father's role in child rearing prior to the divorce action. Who provided the most day-to-day care? Who accompanied the children to doctor's and dentist's visits? Who went to teacher conferences, school plays and sports events? Who assisted the children to dress for school and prepare their homework? Who will care for the children while the father is at work? If the father has legitimate concerns that the mother is incapable of caring for the children properly he needs evidence that will convince the court. However, the motive should be honest concern for the children and not avoiding child support or a desire to hurt or control the children's mother. The lawyer will review the situation and explain the options. Many men take an active role in raising their children. If the father was the primary caregiver then he should definitely be considered for custody since caregiving should be one of the the main qualifications for awarding custody along with health, safety and stability.See related question link.
