That's a good question, Black Powder 'guns' are no longer considered firearms, that's why anyone can order them online and have them shipped directly to their house without a FFL.

I'm going to look into this some more...

Some states consider them to be firearms. In those states felons would be prohibited from ownership. Check with law enforcement in your jurisdiction.

A felon can petition to own and use black powder weapons for hunting or target shooting purposes. However it is up to the judge to grant this right, also during anytime you using the gun you must have with you a court order.

Added: It must either be a genuine antique pistol produced and manufactured prior to 1895, or an EXACT replica of it. ALSO. Felons are forbidden to possess explosives including black powder. How you manage to get around this conundrum, I don't know.
