Depends on the state in which the permit will be gotten and the circumstances surrounding the permit. Some states will allow a 13 year old to get their license if they are the only physically capable person at their place of residence, if they can prove themselves mature enough, AND if they can pass all standard qualifying tests (written & practical, usually).

By & large, if the older sibling is 18+, it has a good chance of being a "yes."

So post your state & I'll see what I can find. That, or you could Google it yourself (which is what I was going to do). Try Keywords like "DMV" or "(state name) driver license" or "(state name) DOT" or visit your state's official webpage (probably a *.gov address).
