I would say , Yes. The reason is , sometimes if a child graduates, the mother may not inform the paying parent that the child did not continue with higher education. So the money continues until the paying parent finds out the child is out of school for good. Usually child support stops at age 18 unless the child has continued his/her education or has special medical needs, etc etc.Tell me if this is incorrect.
If it's your money, yes, but you will have to go through their appeals process first. If that doesn't resolve the problem, you may then sue the State in the circuit courts.
Yes, as an adult you can sue a noncustodial parent for back child support. However it is a different story if the noncustodial parent has never been ordered to pay child support. You can still sue them for a percentage of their assets. I am currently working on a case in which my client is sueing his father for 15 years of back child support. Any divorce lawyer can handle this case for you.
Depends on the state. Texas allows overpayments to be requested from the person who received them although they knew they were not owed. If not, you can sue them. Check you state laws.
Unless there are unusually circumstances, once a minor becomes an adult under the laws of the state in which he or she lives (or as stated in the support order) child support ends. If he or she has established residence outside the custodial parent's home with the approval of the custodial parent, the obligated parent should petition the court to have the support order amended or rescinded. Child support money is for the support of minor children and not "owed" to the custodial parent. The custodial parent does have the legal right to sue the obligated parent for any arrearages or "extra" expenses incurred while the minor child was in his or her care.
Sue for child support? That would be up to the mother to do. And if she did sue, she would be the one to get the money if she won, not the young adult child since the mother was the one who raised and supported the child.
Sue him for retroactive child support.
Not technically. Child support is for a custodial parent to support the child. Check your state laws.
no
Yes a child can sue a parent for unpaid child support if there was a child support order.
If you're in the US, no, a child cannot sue his parent for child support (payment for child support is not due to the child).
If you are separated from the other biological parent, and he is a minor, then you simply sue the other parent for monthly child support.
Absolutely not; the child doesn't owe the parent(s) anything.
no
If they can establish the stepparent as a primary support in a parent/child relationship.
Only if the obligee parent releases the claim or is deceased.
No. Your custodial parent must file a complaint for a child support order in the family court in your jurisdiction.
No. If there were arrears in this case it was owed to the custodial parent. The child does not get child support or arrears.
No, the child can not. The other parent could before the child was an adult. The money goes to the parent to use for the child and not directly to the child.
