First question: Yes, they can come on private property, with some limitations. They may not enter an enclosed building or cross a locked gate.

Second question: Unless they gain consent of the owner of that vehicle, they cannot enter or move any other vehicle in order to get to the vehicle they're repossessing.

Unfortunately, unless the property is fenced in with a locked gate the repossession man is allowed to come on to your property to remove the item under repossession. In fact, if you attempt to physically remove him he can pepper spray you in order to protect himself. They have the right to enter your property and reclaim the goods. However, he can not enter your home, a garage, or dwelling. If it is a car, and it is in the driveway he has the right to come on your property and remove it. They cannot move any of your or anyone's property to attain the vehicle, so if you park another vehicle in front of it he cannot move that to get to yours.

More than likely the person loading the motorcyle will be. You still have a duty to not hit something as big as vehicle, and even though you say on the wrong side of the road, not sure that would hold up on private property, could you have asked them to move the vehicle, etc? Now, this is not to say that the parked vehicle is absolutely without fault, they may be assessed some percentage of negligence. File it with yours and the other companys insurance and the adjusters will investigate the loss, and come to a decision or if they cannot agree they can file it in arbitration....good luck to you......
