Actually, for a least a short time they have to, by law.

That is, any wages not paid and earned from the pre-petition periods (before BK), must be approved by the court, etc to be paid. The reality is this is almost always done very quickly (like 1 day) after filing. Paying wages is given a very high and important status by all. Anything earned AFTER filing BK is payable regardless - and not doing so 9not keeping current) is acted upon by the court...and the court regularly reviews to make sure all POST petition things are being paid.

Does an employer have to pay FICA for a part time employee?

FICA contributions, including various sub (categories of things like SS, Disability, Health, etc) are 15.30% of FICA wages. What is considered FICA wages differ from other wage considerations in many ways, (it has a top limit of about 97.5K, how pension contributions factored, State taxes, etc.). If you are an employee, the employer MUST pay half of the contribution. If your self - employed, the amount normally paid by the employer is collected through something called the "self employment tax" when you file your income tax return.

Can they hold your check if you dont write a letter of resignation?

In the United States, an employer cannot legally withhold a departing employee's paycheck; in some states, the employer must pay the employee all of the wages due him on his last day. There may be a narrow exception in some jurisdictions for cases in which the company loaned or advanced money to the employee, and there is no way to recoup the loan except by a deduction from the final paycheck. But an employer cannot withhold a paycheck from an employee simply because he did not write a letter of resignation. If this happens, an employee should file a complaint with his state's Department of Labor. The employer may subject to fines. For specific information about your state, visit the Labor Law Talk forums and look for your state's discussion board.
