If you remain unmarried you will be able to collect on your ex husband's social security. This becomes null and void if you remarry however. A case worker from the Social Security Administration will help you with the paperwork.

Yes. You are eligible to draw retirement benefits against a living ex-spouse's work record if you are at least 62 years old, were married 10 years or more, are not currently married, and your ex-spouse is entitled to receive benefits.

If you ex-spouse is not entitled to receive benefits, you may still be able to entitled to compensation if, in addition to the requirements mentioned above, your ex-spouse is at least 62 years old and you have been divorced for two or more consecutive years.

From the Social Security website:

If your ex-husband is deceased, you can receive benefits-

  • At age 60, or age 50 if you are disabled, if your marriage lasted at least 10 years, and you are not entitled to a higher benefit on your own record.
  • At any age if you are caring for his child who also is your natural or legally adopted child and younger than 16 or disabled and entitled to benefits. Your benefits will continue until the child reaches age 16 or is no longer disabled. You can receive this benefit even though you were not married to your ex-husband for 10 years.

Also, I believe you cannot be currently married unless you remarried after the age of 60, 50 if disabled, or are caring for a child under 16.

Can you draw on your deceased Ex husbands Social Security?

Yes, if you were married for at least 10 yrs. you can draw your deceased ex-husband's social security, but there are some stipulations. If your ex-husband died at or after his full retirement age & you are at full retirement age when he died , then you can collect 100%. Other than that, only a % of his social security can you get. You can call SS & ask them to send you the booklet that explains it.
