divorce.
You are free to date whether you are married or not but keep in mind that you are married until your divorce decree is final. There is no law that addresses dating during a divorce but it may be used against you in some way during the divorce proceeding.
If your spouse gives you permission. He could also sign the title over to you.
You cannot file a civil lawsuit unless you can show that you yourself suffered large dollar damages. What dollars did it cost you for an illegal to be hired? Remember, it is not illegal to hire an illegal alien. It is illegal to KNOWINGLY do so. 90% of illegals commit identity fraud, offering fake docs to get a job. The employer has no duty to confirm ID ... only to see the ID and keep a photocopy.
A divorce and a restraining order?
You don't know. If he can't keep his promise to his wife, what can he tell you that will be convincing?

If she is married to a man that was previously married to another who divorced their previous partner then you should keep your distance as she is married! I am not expert, but i believe that most immigrants (if not all of them) who married a US citizen and, because of that, got a greencard do (yes) get to keep their green card. So ladies (and gentleman) be sure that your immigrant fiance/ee marries you out of love, and not that "card." >>>>The immigrant gets to keep the green card, but cannot apply for citizenship, unless the US citizen was abusive towards the immigrant. The USCIS, however, is very discretionary in these cases and it ultimately depends on the Hearing Officer and how you present the reasons for your divorce and they determine if the marriage was not fraudulent. My advice is that you get divorced after you receive your citizenship, provided the marriage was not fraudulent, becasue if the marriage was a fraud, they can still revoke your citizenship.
The Final Divorce Decree in esense nulls the Marriage License, so it does not need to be kept any longer than one feels necessary. In the divorce documents the fact is made that the union between the married couple is to be dissolved, so unless you want to keep it for nostalgic reasons, then it's ok to discard it. If there are kids involved in this divorce, they may wish to keep it for some reason.
