Is a private road open to the public?
Per West's Law Encyclopedia: A private road is often established because an individual needs to gain access to land; such a road can cross another person's property. A private road can be used by the general public and is open to all who wish to use it, but it primarily benefits those at whose request it was established. Unlike highways that are cared for by the public at large, private roads are maintained at the expense of the private individuals who requested the road. Anyone visiting a resident of the road can use it. Anyone performing work on any properties along the road can use it. The mail carriers can deliver mail; oil trucks can deliver oil and door to door sales people can use it. Private ways are often "dead end" streets and generally have scant traffic. However, if not a dead end a private street may be used by the public as a cut-through to another street. Towns will often make minor repairs to private ways, such as resurfacing, upon petition by the abutting owners. However, there may be charges for that work. State laws that affect private ways vary from state to state.

Can anyone use a private road?
If a landowner sells lots (or a single parcel) that front on a private road, generally, the law provides the right to each lot owner and their invitees to use the road for access whether or not that right is granted in the deed. Town services such as police, fire and ambulance can also use the road.

Is a private road considered a public way?
No, it is a private road, which means it is not owned or maintained by the public. However, in some jurisdictions, a private road may also be "dedicated to the public use", meaning the road is open to public use, making it a "public way", at least in the sense that you can drive on it. This is common in forming a new subdivision: the new access road remains private, but the town wants it dedicated to the public use.

What are your rights as a homeowner on a private road?
Generally, if you were sold a lot that has frontage on a private road you also acquire the right to use the road for all purposes of a public way, in common with other owners that have frontage on the road, as long as the person who originally owned the lot also owned the road. Private road issues are complicated and you should contact the attorney who represented you at the time of purchase if you have questions about your rights.

If pedestrians walk down posted private property no trespassing road which is an easement on my property for ingress and egress to four other properties behind me is that trespassing?
If the four other properties all have easement rights in the road for ingress and egress under certain circumstances pedestrians would have the right to use the road. A visitor could use the road to reach the house of a friend. Invited guests and friends of the children in the four houses could use the road for access. Someone selling girl scout cookies or looking for signatures of registered voters on a petition may have the right to use the road. People who are simply out walking and have no business with any of the four homeowners may be trespassing. You should seek the advice of an attorney in your area who could explain the provisions of your state laws regarding the use of a private road and also the language that created the rights to use the road.

Answer 1 A private road is open to the general public. When a road is private, all it means is that it is not maintained by the city or government and is maintained by those who use it. The "private" part of the name doesn't mean nobody can use it, it means privately owned - like a privatised corporation - something run by the public not the government. However, a business should make sure that the road can be used for commercial purposes. Private roads are processed and approved by the court, because of planning regulations and the fine line between the definition of private and public roads. A business needs to check with the court that the road can be used commercially. if the commercial business attracts too many visitors then the court may decide to make a part of the private road a public road. Seek a lawyer if you need advice. Answer 2 Only in certain conditions. The easiest way to gain access to a private road is to buy an easement from the private road's owner. If there is no way to access the property other than by using the private road and the owner denies you the right to use it, you MAY be able to sue for a prescriptive easement in court for the extent of the private road necessary to access your property. You use "does" because the word anyone is singular (any one person). Likewise for the words someone, everyone, anybody, somebody, and everybody. Examples: Anyone who does something wrong may have a guilty conscience. What anyone does while driving can affect other drivers on the road. Does anyone have another sentence example?
