As long as the water level is not above the tortoises head, they are safe. If a tortoise is kept as a pet, it is important to provide a shallow dish of water for it to drink from and stand in. It is essential that the dish is the correct shape and position so it will not tip over when the tortoise tries to climb back out again. There are one or two species of tortoise that are able to float, and maybe swim a little way using a "doggy paddle" style, but these are few and far between and not normally kept as pets.
