The data is recorded in electronic formats. Black boxes hold approx the last 30 minutes of data created. Its then over written and re-saving starts. A plane can product terra bytes of data each flight. Which is why mass storage is not looked at (cost). There is currently some data transmitted called ACARS. This can be switched on and off by the crew and send back to the manufacturer data on air frame and engine performance. However, there is a cost to this and air companies are trying to save money as costs soar. therefore they switch off the ACARS unless it contracted that it is sent.

There has been discussion within the IAA as to if and how this data could be beamed out and retained for the life of the flight by the carrier. Again COST is the issue as it will require communication systems, such data could be used by terrorists to identify weaknesses etc and a mound of other reasons. Again scrambled data will add cost to the flight.

It does appear that some commercial companies feel that this process is something of a big brother attitude and see litigation as a result of data being used against them.

The FMC (flight management computer) on board most commercial aircraft transmittes data back to the companies but this is in small packages in hundreds of bytes only as this is also a cost to the business.
