Yes, unless you have a criminal record that indicates you can be a danger to the children or you have been detained or questioned for child abuse and it was determined that you were At Fault for that. The court is supposed to do what is best for the children. So if the Grandparents are "stinkin" rich you're going to have an uphill battle if your income is limited. But if you're clean you have every legal right to have those children as the next of kin. This is how it is in California. I don't know where you are but I hope this helps.
