It is illegal for anyone to threaten anyone with jail time. However, repossession drivers may as a rule warn debtors that if they do not surrender the vehicle that the potential for arrest exists. This is not a threat. Many lenders will automatically authorize the petition of replevin when a debtor refuses to cooperate. If a replevin is served on a debtor and that debtor refuse to surrender the vehicle, he is likely to be arrested, and held until he surrenders the vehicle, or a judge is satisfied with the time the debtor serves for contempt of his order.
Answer to Impersonating a repo manAnswer to "Can a person impersonate a repo man?" Not if you want to go to jail for grand theft-auto larceny or willing to be shot and\or killed.
Yes. If he has a repo order, it is no longer YOUR truck.
Yes but he is not allowed to tow the vehicle with a person in it.
Probably not. He'd probably ask you to get out of the car.
Yes
NO, not for just being repoed.
NOT just for a simple repo NO. IF there are other complications added to the repo, maybe.
drive it away
Its not as easy as it seems. Is your truck gonna handle the work SAFELY? REPO insurance is sky high.
The "penalty" is a repo on your CR.,higher interest rates on future loans, and a possible judgement/wage garnishment against you. A repo is a repo is a repo in credit files.
Yes, if you are not making the payments the bank can repo your truck.
Legally, no. This would fall under wrongful incarceration or kidnapping. The repo agent can block the vehicle in until that person gets out and then hook the unit. If the person re-enters the vehicle afterward then all bets are off. If the police are called in this situation, someone is likely to go to jail for breach of peace, and the repo agent has a legally binding notice of repossession.
