Yes.

Although a court would consider such a report as highly valuable in determining the nature of an accident, and while it may be very helpful to a court in determining fault, there is no legal requirement for a police report to be done in order for civil liability to be assessed from an accident.

How long do you have in South Africa to report a car accident?

A driver of a vehicle which has been involved in a road accident must report the accident within 24 Hours of its occurrence to any metropolitan, municipal or city police department, traffic department in South Africa or police station of the South African Police Service(SAPS). This must be done in terms of the National Road Traffic Act, Act 93 of 1996. This is only applicable if a police / traffic officer did not attend the accident due to the apparent minor nature thereof. However, the hours of operation of these departments/ offices must be taken into consideration.

What do you do when someone files a false police report in California?

Filing a false police report is a criminal offense. If you know of someone who has done this, you should notify a police agency, preferably the one where the false report was filed.

Is it required either by law or insurance company to file a police report on an accident?

I can speak for the State of Indiana on this one. When two parties are involved in an accident and the TOTAL of damage to BOTH vehicles AND any third party property is $1,000.00 or more a police report is required(by law). A form called an SR-21 is also required in Indiana to be filled out and sent to the BMV within ten days or the drivers licenses of the non reporting party will be suspended. Insurance companies have their own guidelines that you agree to when you sign your policy. The prudent thing to do in any accident is to have a police report done as well as report it to your insuance company. One reason, being the phenomenon of damage increasing after the accident as well as the neck pain that seems to come about after the "victim" has been talking to friends and relatives.

Will insurance cover your car in an accident if you didnt file a police report?

Yes, Most states today dont even send out police or law enforcment unless there are injuries. The most common thing done today is swapping insurance info. if someone else is involved.

If a blood test is administered for an alcohol related accident and it doesn't say on the police report where it was done at can it be used in court?

Certainly. The officer probably has no idea where the blood was taken to be tested. As long as the evidence chain of custody is maintained it won't be a factor.

Will your insurance cover you if you back into a pole and dont have a police report?

Backing into a pole hardly warrants a police report. Police reports are commonly done only when two vehicles collide on a public street. You simply go to your insurance agent and tell them that you backed into a pole, and they will take it from there and tell you what has to happen to get the repairs done.

What can you do if someone hits your car from behind and totals it but you dont have insurance and they do?

If it was their fault, their insurance company will cover the damages of your vehicle. I would hope that the person at fault has filed the claim already but you need to make certain. I also hope that a police report was done at the time of the accident.

What happens to your claim if the police report declares the other driver at fault in an accident but the driver challenges the report?

The first thing you need to keep in mind is that the police report does NOT make the determination of liability. The claims adjusters do that. The police report is a useful tool to the adjuster, supplying details that their insured probably cannot provide. However, the focus of the police officer writing an accident report and the adjuster reading it are different. The police officer focuses on the following (and pretty much in this order): 1. Was there a civil traffic code violation by either driver and was it 'citable'? 2. Were there any injuries? Is transport needed? 3. Are all involved vehicles registered, carrying current plates, and free from any violations pertaining to safety and driveability? The adjuster focuses on questions which will enable her to come to a decision on who is 'liable' in the accident. (That can sometimes be BOTH drivers; all states have comparative negligence laws. This means Driver A can be x% at fault, while Driver B is y% at fault.) She will focus on many questions, such as the following (and sometimes, others not included here): 1. Who had the "last clear chance" to avoid the accident? 2. Did Driver X do what a reasonable person would have done in the same circumstances? 3. Where are the damages on both of the vehicles? There are likely several other questions, dependent on the accident details/description. Additionally, with the involvement of injuries, additional questions come into play. But the police report should NEVER ever be the basis for a liability decision by a claim adjuster. If you think this happened to you, ask for a full written explanation of his liablity decision.
