I doubt it. Many have a criminal record from their youth for instance and that does not stop them from being great parents. So unless she is doing criminal things now you will not get full custody.

No. Not unless you were actually taken into custody.

Is 50 50 custody recommended by the courts after a divorce?

In many cases joint custody is recommended when divorcing because children come first. To children their parents are still 'mom and dad' and if young they do not understand what is going on and in some cases the children can blame themselves for their parents divorcing. For many children divorce is a trauma in their lives. The only way a parent may not get joint custody is if they are drug users; alcoholics; verbally or physically abusive to the mother or children; have a bad criminal record or cannot give a safe environment to raise their children.

Does time in juvie go on youre permanate record?

Time in custody does not go on a criminal record. Your criminal record shows what you were convicted of and when, not what the punishment was. A conviction of a crime as a juvenile generally doesn't go on a lifetime criminal record. Instead, it is usually held in a sealed record. However, it is sometimes required that the juvenile petition that the record be sealed upon his/her 18th birthday. This depends on the state.

Do you have a lesser chance of getting custody of your child if you have a felony on your record?

You don't necessarily have a lesser chance of gaining custody of a child if you have a felony on your record. It depends on the circumstances of the felony and on the history, criminal and other, of the parent applying for custody. One thing you can do is you can try to get your criminal record expunged, and that way you will have better chances of winning custody. Anyone eligible for expungement should do this, since it will significantly improve their chances of getting a job or a student loan, as well as improving their opportunities in other areas. Good luck!

If you have a criminal record would you win primary custody if you have a better environment?

Can an unmarried father with a prison record gain custody of children?

Hell yes! I had a record when I was 18 - I'm now 74 and have been raising children ever since. Having a record doesn't make you unqualified to raise children.

Can a father get custody of his child with a criminal record and the mother no criminal record?

It is possible, yes. It is unlikely, however. Most states use "the best interest of the child" standard to determine custody and visitation. The court would have to determine that the child would be better off with the father than with the mother, looking at each's circumstances and track records. The fact that the father has a criminal record does not automatically exclude him, but it will probably be taken as a sign of his bad character. Of course, the date the offense was committed and the type of offense will make a huge difference here.

Can the father get custody of his 3 children if the mother loses custody of them for reasons of neglect and they are placed with their grandparent?

Yes, unless you have a criminal record that indicates you can be a danger to the children or you have been detained or questioned for child abuse and it was determined that you were at fault for that. The court is supposed to do what is best for the children. So if the Grandparents are "stinkin" rich you're going to have an uphill battle if your income is limited. But if you're clean you have every legal right to have those children as the next of kin. This is how it is in California. I don't know where you are but I hope this helps.
