There is no 'one answer fits all' for such questions. Each case is looked at individually. The rights of the child are protected by the court. It is the responsibility of the adults who care for the child to bring the abuse to the attention of the court and insist that the court appoint an advocate for the child and an investigator to examine the child's experiences and environment. To get legal rights to a child, you must go through the court system. The child's parents must agree or you must go through child protective services to get custody.
