It's theoretically possible to have any conviction expunged, but it doesn't happen very often. For an arrest or conviction to be expunged, the petitioner has to show the court that either a substantial legal error occurred (such as a false arrest), or that justice would be best served by "erasing" the offense. This is occasionally done after a substantial time (many years) has passed since the offense, and the accused has led an exemplary life in the interim. It isn't done just because the accused finds it inconvenient to have that conviction on his record.
Added: THEORETICALLY being the keyword. While it may be possible to APPLY to expuinge this offense, I do not believe that it is possible in ANY jurisdiction to expunge a domestic violence charge.
They are treated as serious criminal events. The Lautenberg amendment addresses Domestic Violence offenders in the same way as if the perpetrators were convicted felons.
No. Criminal Domestic Violence is one of the offenses which cannot be expunged in any state.
no
Maybe he's just telling you that, or maybe he wasn't actually charged with Domestic Violence but with a lessser offense such as . . . . . perhaps Simple Assault. The actual charge of Domestic Violence cannot be expunged.
It can be expunged, but getting it expunged doesn't make it go away - it just limits who can see it.
Yes.
You may purchase a gun regardless of whether a misdemeanor was a expunged or not. That is unless the Misdemeanor was for domestic violence. Anything Domestic Violence bars you from purchasing a firearm.
Arkansas code 5-37-302 refers to wighting bad checks ( hot checks ) ... this law has been amended many times ... but it will never be expunged ...
You should look carefully into the circumstances under which you had this Domestic Violence record supposedly "expunged" and who told you that it was expunged. It is my understanding that Domestic Violence is NOT an expungable offense.
Domestic Violence is one of the charges that cannot be expunged from your record.
No, they cannot.
forever can not be expunged or pardoned
It will depend on what the specific charges are. Felonies are set at either 3 or 6 years depending on the level. Misdemeanors will be set at 1 year. This can be tolled for up to 3 years if they are absent from the state.
