Although you may very easily find a lawyer willing to take your money to try, you will not be successful in suing Dairy Queen for lack of a loop, since they are not contractually obligated to provide a loop. Also, it isn't considered false advertising if they never state in any of their advertising that you are guaranteed a loop on the top of your ice cream.
However, as a sidenote, Dairy Queen does have a trademark on their "signature curl."
