Of course you can sue. I am constantly called as an expert witness and recently after my deposition the insurance company decided to pay an out of court settlement in excess of $100,000.

Results do vary but having testified for many years in civil supreme courts I never lost a case.

If you have a decent law firm working with the right expert your changes of success increase dramatically.
