YES, IF YOU ARE GOING THROUGH A DIVORCE, YOU NEED TO ASK FOR CUSTODY AS PART OF THE DIVORCE SETTLEMENT. THIS WOULD BE THE BEST TIME TO DO IT BECAUSE IF SOCIAL SERVICES ALREADY TOOK THE CHILDREN FROM THE MOTHER , THE JUDGE WOULD EASILY GRANT YOU CUSTODY THE CHILDREN.

Yes The National Guard is a military orginization and you have made a commitment to it. They can and will send you to Jail if you go AWOL Some things to clarify here... the only time you can actually be AWOL from a National Guard unit is when that unit is federally activated under orders which transfer the command from the National Guard to the Regular Army... ipso facto, it's technically not possible to be AWOL from the National Guard, since the unit is no longer National Guard when activated in such a fashion. If you miss UTAs, that's not treated as AWOL.

That depends on how many enlistments you already have, what your skill level (corresponding with your rank) is, and what the needs of your state's National Guard are. Talk to your unit retention NCO about this. The options for someone in the California National Guard and the Delaware National Guard are going to be very different, and we don't have the benefit of knowing what state you're in, what your current MOS is, or any of the information I listed above.

Depending on the state you reside in, I know VA you can. You should be able to fileseparately for child support and custody. Then later have the provisions added to your final divorce decree. If you are living separately and have reason to believe that custody will become an issue, you are risking a lot by not going to the courthouse and simply attempting to file for it. If you don't have an attorney to advise you, get on line and start doing research in your states on line law library. Sometimes, in nasty situations, people are unaware that a divorce can take a long time, however custody is usually quickly resolved and without it, either parent can take off with the child wherever they choose.
