Grazie al c.d. Visa Waiver Program (Viaggio senza visto), i cittadini italiani non necessitano un visto per recarsi negli Stati Uniti per un periodo inferiore a 3 mesi. A partire dal 12 gennaio 2009 coloro i quali intendono recarsi negli Stati Uniti usufruendo del Visa Waiver Program, dovranno richiedere un'autorizzazione al viaggio elettronica, (ESTA -Electronic System for Travel Authorization) prima di salire a bordo del mezzo di trasporto, aereo o navale, in rotta verso gli Stati Uniti.
Per usufruire del programma "Visa Waiver Program" (Viaggio senza visto) è necessario:
- viaggiare esclusivamente per affari e/o per turismo
- rimanere negli Stati Uniti non più di 90 giorni
- possedere un biglietto di ritorno.
In mancanza anche di uno dei requisiti elencati, è necessario richiedere il visto.
Esistono differenti tipologie di visti d'ingresso che si possono richiedere a seconda della motivazione:
· Visto B-1/B-2 : per affari o turismo
· Visto F-1 o F-2 o M-1 o M-2 : per studenti
· Visto H-1 o H-4 : per lavoratori temporanei
· Visto J-1 o J-2 : per visitatori e/o programmi di scambio
· Visto L-1 o L-2 : per trasferimento di Personale da un azienda all'altra
· Visto O-1 o O-2 o Q-1 : nell'ambito di attività sportive, artistiche e/o culturali
· Visto R : per i religiosi
· Visto I : per giornalisti, inviati, corrispondenti, mass-media, ecc.
Le procedure per ottenere i diversi tipi di visto sono soventemente complesse e l'unico vero modo di ottenere un visto che permetta di operare negli USA é quello di rivolgersi a un avvocato americano specializzato in leggi sull'immigrazione. Adottare un approccio "fai da te" risulta quasi sempre fallimentare.
