It is illegal to sell a car with a lien on it. If it has a lien you will not be able to register the car in your name. The loan must be paid off and the lien released before you can actually own the car. You may have just got scammed.

Can a debt collector put a lien on your car if it is registered to your spouse?

No, if it is your debt only and your name is not on the car. Unless you used the car for collateral for a loan, they can't put a "lien" on it anyway.

Can bankruptcy lawyer have lien removed from car?

If the lien is a purchase money lien (granted to allow you to buy the car), then no. If it is a nonpurchase money lien (you granted a lien on the car to secure an unrelated debt), then yes.

What if someone has sold you a car with a lien?

I think you may have meant "lien" instead of "lean". A lien is a monetary (money) debt placed against a possession by a creditor who has not been paid by other means. If an owner sells his cat on which a lien has previously been placed, the lien belongs to the person (i.e. the other person who owned the possession before); a lien does not "follow" the car or other possession, it follows the person who owes the debt. If a seller sold you a car with a lien against it, you need to contact an attorney to get the lien removed from your-now-owned car. You or your attorney needs to notify the creditor/lien holder that you bought the car without knowledge of the lien. The creditor would then need to identify a different possession owned by the other person in order to attach the lien to that possession, and not to your car.

yes

Can an individual put a lien on a car?

No. Only a court can issue a lien. You would need to sue the car owner in court for a debt and win a judgment. The court could then issue a judgment lien and the sheriff could seize the car to pay your debt. A judgment lien could also be used to take any other personal property to satisfy the lien and it could be recorded in the land records if the defendant owns real estate. In that case, the property could not be sold or mortgaged until the lien is paid.No. Only a court can issue a lien. You would need to sue the car owner in court for a debt and win a judgment. How can you get a car lien release?

Pay off the debt (including all accrued interest) associated with the lien, at which point the lien holder will send the release papers. If they don't send these papers, contact them. This applies to any lien: car, house, land, etc.

Can a car be taken to pay off credit card debt?

Yes. A car can be taken for a credit card debt if the creditor sues you in court, is successful and obtains a judgment lien. The creditor can use that judgment lien to take any property you own including your home and your car and your bank account.

Can your car be repossessed if you have the title in your possession and the bank is not the lien holder?

Repossession occurs when the borrower fails to make payments on a loan secured by a vehicle. If "the bank" is not the lien holder then it has no authority to take possession of the car by repossession. However, if a bank obtains a judgment lien against you in court for a different debt, it can use the judgment lien to seize your car, or any other property, to satisfy the judgment.Repossession occurs when the borrower fails to make payments on a loan secured by a vehicle. What happens to the lien on car when the company no longer exists?

If the company holding a lien on a car ceases to exist, its assets are usually bought up or inherited by another company. A lien is an asset, so the lien continues to exist and you pay the money to the new owner. If the lien is held by one company but the car manufacturer ceases to exist, the lien stays the same.

Yes. The person you bought it from should have given you a clean bill-of-sale. Take all your personal stuff out of it, as it will soon and legally be gone.

If a cars title status says lien is it ok to purchase the car?

If the car has a lien on it, that means someone else has legal right to the vehicle probably for the balance of a car loan or due to non-payment of the car loan. If you purchase the car from its owner then you will be responsible for paying the lien or the vehicle may be repossessed by the lender or seized to pay the debt. You would need to obtain a valid release of the lien and follow the appropriate steps to have the lien released if you want to acquire a clear title.

If you have a judgment lien can your car be repossessed?

If it's the owner of your car loan and you defaulted then the car can be repossessed. If you have a judgment against you for any other debt then yes, if you own a car it may be seized by your creditor to cover the cost of your debt.

Can a debt collector repo your car is they are not lienholder on title?

No. To be able to repossess any of your property, they must hold a lien on it. If they have no lien on it, they have no right to repossess. Their only option is to take you to court.

If you were charged with but found not guilty of a 2nd DUI and you car was seized will a Chapter 7 take care of a lien put on your home for the car?

A petition can be made to lift the lien. It is almost certain the lender will object and more than likely the lien will remain until the debt is paid in full.

If you filed bankruptcy and one of the creditors had a lien on a car do you get the title back after the bankruptcy is final?

Normally, as a secured creditor he would get to repossess and sell the car to recover as much of what you owed. Or if you reaffirmed the debt, then the lien stays as does your obligation to pay.
