If the easements affected the land prior to the granting of the mortgages the property remains subject to or with the benefit of those easements. If an easement was granted aftera mortgage and the lender consented then the property will pass subject to the easement.

Do easements transfer when property is sold?

Yes. When landowners grant an easement they are effectively selling some portion of their ownership rights in that land, so they can't sell the easement. The deed of sale must cite any diminutions of the selling owner's rights in the land being sold, and that includes easements. So, while ownership of the land transfers, ownership of the easement rights remains with the easement owner.

Does a person have the right to be on a easement if the easement holder does not give them permission but the land owner does?

Are easements considered real property?

An easement is an interest in real property and easement rights are usually bundled under the definition of real property. An easement is an interest in land owned by another person consisting of the right to use or control the land, or an area above or below it, for a specific limited purpose. The land benefitting from the easement is the dominantestate. The land burdened by the easement is the servientestate. An easement can last forever but it does not give the owner any fee interest in the land. There are many types of easements such for access, installation of utilities, installation of pipeline, installation of septic systems, sight easements, sidewalk easements, well and aqueduct easements, etc. In some cases easements are granted to a neighbor whose garage encroaches on the abutters land. That type of easement generally lasts only until the structure needs to be rebuilt.

What is an eastment?

Answer: I assume you mean to say "easement". That is a right one owner has to make use in some way of the land of another. Easements rights are granted in or by deed. Easements are sometimes acquired by operation of law (by necessity).

What is the difference between a license and an easement?

A license is a permission granted by a property owner that allows someone to use the property for a specific purpose, while an easement is a legal right to use someone else's property for a specific purpose. Licenses are typically revocable and do not create an interest in the land, whereas easements are more permanent and create a property interest.

When a survey is done on a piece of land wouldn't there need to be an easement or entrance listed for that land?

Not necessarily. A survey can be done for many reasons, only one of which includes sale or transfer of the land or a portion of the land. In fact, there may be references to other deeds of abutters that would contain the easements for access to the surveyed parcel. Or it may be that the land is "landlocked" and access will be provided by statute (e.g., sue for an easement, or an easement of necessity is implied in law, etc).

Do all land parcels have easements?

No. An easement is a right in, over, above, or under land for a specific and limited purpose such as power lines, water lines, drainage, and roadways. If no such right has been granted by any previous owner, there is probably no easement in effect. However, most parcels with road frontage or utilities will have easements in place for those purposes.
