yes you can, you just go into any phone shop and buy a blackberry and there already unlocked. blackberry's are only locked if you get them off eBay and those sort of websites. i got one from carphone warehouse but my blackberry messenger isn't working so ill be carefull about blackberry messenger, :).
almost all modern blackberry smartphones nowadays have BBM, so it does have it, and if it doesn't come with the phone, you can download it from BlackBerry App World or from the BlackBerry official site.
