Another View: This is an unsettled area of law. If the information contained within the device is suspected of containing evidence of a criminal offense, the best way to handle it, to be absolutely certain that it is not ruled inadmissible, is to request a warrant to search the device's contants..
HOWEVER - the difficulty of this is that probable causemust be shown that the information IS contained in the device, and without first looking at the contents of the device one cannot know for certain. Unless/until this question is decided (probably a future Supreme Court case eventually) it will probably continue to be handled in a piecemeal case-by-case fashion by both law enforcement and the courts.
