USERRA fed law says the employer must allow you to go. It need not keep your job open, but must return you to your job - firing your replacement - if you return within five years. Keeping your job unfilled for years would lower productivity, and no law requires that.

A person who quits has no right to their job. A person who takes military leave for up to 5 years DOES get their job back when they return, even if it was filled while they were gone.
