Normally yes. The main exception is that Playstation Plus users can have the PS3 set to download any updates to games or the system. It still must be on when the download occurs, but the system turns on the PS3 when a download is available. You also have to not be doing certain things while you are trying to download. I found if I watch a DVD or other activities the download will pause until I am finished even though it was set to download in the background.
No PS3 does not have Live they have the free Playstation Network and for the cost of Live you can purchase Playstation Plus that provides members with free games and reduced download prices. You do not need to join Playstation Plus to play on the internet or use any of the Playstation Network features
