Yes, he or she simply needs to take his/her illegal body and return to their homeland by plane, train, automobile or the same two feet that they walked in to the U.S. on. The U.S. does not control or check visas for outgoing travelers, so it's really a non-issue. Anybody leave the U.S. any time that they wish, and no U.S. Government official will stop them or evern question them. This was one of the issues with the 9/11 attacks, many of the terrorists were visa overstays, but nobody knew that, because the Immigration law is not enforced in many instances.
Of course! Being married does not affect one's legal status, even a legal alien can be deported for criminal activity.
Unfortunately, an illegal alien can not become an US citizen if they have been deported before. If they have a felony, they can't become a US citizen either.
Can an illegal alien who was deported and barred for ten years come back sooner by marrying an us citizen?
No it cant cuz it was born here
I believe that if your child is a US citizen you cannot be deported. You need a lawyer.
Legaly, NO. The mere act of being in the US illegally means that if caught, the illegal alien will be deported. Marriage and children do not change the rules. Depending on rulings of the Immigration Court involving custody, the children also may be deported. However, once deported, the alien can apply, at his countries US embassy, for LEGAL entry into the US, a green card, and other ways of being reunited with his (I assume Legal US Citizen) Family. There will be fines, starting at $1,000 that will have to be paid before making the applications.
yes, my ex-husband is going through this with his wife, they have 2 small children and have been married for almost 7 years. She is being deported around the first of the year.
You can, but it wouldn't be advisable. The illegal alien can be deported at any time. It may even be impossible for them to get back to the US.
no
It is not possible for an illegal alien who has been deported to become a US citizen. Certain crimes will put a short term bar on the aliens from applying for a visa to enter the US. Even if they manage to get a visa, it will be very difficult to become a US citizen. Their past felonies and deportation charges will act against their citizenship application.
It is a rule stating that if you are married to an US citizen then you will be considered an legal citizen.
yep, call your local INS and point them her way.
