How can i get my son's last name changed if the father lives out of state and hasn't been involved in his life in almost a year?

If you're in the US, you'd have to petition the court for a legal name change. They would contact Dad and give him the opportunity to contest it. Even if he doesn't contest it, if he pays child support (rather he sees the child or not), there's a fair chance they will deny your request.
