Your question is confusing. "How do you divorce a prisoner for 1." What does "For 1," mean? Otherwise, anyone divorces a prisoner just like anyone divorces anyone else. You go to the court that handles divorces and file for divorce. You serve papers on the other party. The prison has a process whereby they will bring the prisoner to a special holding cell where the person serving the papers can serve them.

The prisoner may represent himself or herself in court in person or by telephone or through an attorney. It varies according to location.

Can you receive Social Security benefits if your spouse is in prison in the state of Louisiana?

Social Security eligibility is regulated by federal, not state, law. If you are already receiving Social Security benefits when your spouse becomes incarcerated, your benefits will continue, but any benefit that was payable to your spouse will stop. If the incarcerated spouse's checks or direct deposit continue after 30 days in jail or prison, you will have to return the money to the Social Security Administration. If you were not receiving Social Security benefits prior to your spouse becoming incarcerated, you will not be eligible to file until he (or she) is released from prison. This is a general rule to which there may be some exceptions. It would be wise to call the Social Security Administration at 1-800-772-1213 and explain your situation to a representative.

If married in France can you divorce in ny?

Yes, you can divorce in New York state no matter where you married, providing that at least one spouse meets the residency requirements for divorce in New York State. Currently, you must live in NY state for 1 full year before filing for divorce. If your spouse has never lived in New York state and the causes of the divorce did not occur in New York state and you were married elsewhere, then you must wait 2 full years.

In AB Canada how long is the wait before a divorce can take place if spouse refuses to sign the divorce?

I believe that you can be granted a divorce within 1 year of separation with or without his signature. There will likely be more paper work to file though. Good luck!

Married in California can you file for a divorce in buffalo?

You can file for divorce in the state you were married in (even if neither you or your spouse currently live there) or in the states in which you and your spouse are residents of. Typically, to establish residency in a state you need to live there for somewhere between 6 months to 1 year. That being said, it is best to file for divorce where you live now to save yourself the trips to other states but nevertheless you have options.

Is there any kind of suit for adultry in cailf?

if one spouse files suit for divorce against the other, she may be in for a long wait. While state law permits a no-fault divorce, couples who agree to part ways must remain separated for at least 1 year before filing for divorce on "no fault" grounds. After 2 years apart, either spouse can get a divorce for any reason. But filing on certain grounds allows the petitioning spouse to have her case heard expeditiously--and one of these grounds is if she claims that her husband is engaged in an adulterous relationship (the other is on grounds of cruelty).

Can you get a divorce in thirty days in North Carolina?

It all depends on the specifics of your case. To get a no fault divorce in NC. you will need first to have been separated for 1 years and 1 day; and the plaintiff must have been a resident of NC for at least six months. If you meet both requirements, than you can file for divorce. Once you have filed before the court, you will need to wait 30 days for the other spouse to file an answer (if the spouse has been served) or 40 days if the notice was given by publication. If no answer has been filed (or the answer has been waived) you can request a divorce hearing and the timing will depend on the overload of the court. If, on the other hand the other spouse files an answer, than you will need to wait for an additional 30 days, making now 60 days from the original filing, prior to be able to have a divorce hearing.

If your spouse does not sign the divorce papers in the state of Florida can i make the divorce final on my own?

Florida is a no fault divorce state. That means that you can get a divorce for any or no reason at all. If your husband won't sign divorce papers, then you're going to have to file a petiton for divorce in court. If you have no minor children or real property, you qualify for a simplified divorce. In any event, the main courthouse in any county in Florida should have a self help center or go to the clerk's office if your county does not. Most forms used in court are readily available as they have been approved by the Florida Supreme Court for court use. If there's no self help center and the clerk can't help you, go to the library in that courthouse or a local law school library and ask for help in finding the necessary forms. Many counties have a legal aid program if you want help and your finances are lacking or you can always hire a lawyer. In short, you don't need your husband's permission or cooperation to get a divorce. Good luck!

Dose Maryland have a residency requirement to file for a divorce?

All states do. Maryland laws require at least one party to have resided in the state of Maryland for one (1) year before the divorce forms are filed, if the grounds for divorce occurred outside the state. If the grounds for divorce occurred within the state of Maryland, there are no residency requirements but at least one spouse must be a resident of the state of Maryland.

How long can you remarry after divorce in pa?

The answer to this question may vary from state to state. From what I have gathered it is anywhere between 1 month and 6 months... however you must understand that if you remarry within 1 month of your divorce, your ex-spouse may have reason to believe that an affair was present before the divorce was filed. He/she can rebuke anything the judge said and have a new trail if he/she can prove the affair.
