1st and 2nd Generation iPods do not have the capability of running on iOS 4. If your iPod does have capability, then you will get a reminder to update the software when you plug in your iPod to iTunes.
The iPod touch cannot update past iOS 3. If it could, it would be really slow and give you anxiety anyway.

I am assuming you have a 1st generation iPod Touch. If not, I don't know why it wouldn't work, and you should email someone from Apple or call. If you do, then you need to download newer software that enables your iPod to have apps on it. You can do this by plugging your iPod into the computer it is set up with, and then clicking on it under the devices tab on the left. Near the middle of this page, it should say something about newest software being available for update. Just download that software and re-sync your iPod Touch and the app should be on your iPod.
There are certain games that you cant get on the ipod 1st generation also you you cant update ipod 1st gen with the new softwares but with the 3rd gen you can carry on updating it.

iBooks if available on 2nd, 3rd and 4th generation iPod touch with the iOS 4.0 update or higher. Since 1st generation does not support iOS 4, iBooks is not supported for 1st generation iPod touch.
Yes, The Nike Plus system works with any iPod Nano. 1st and 2nd generation. You should update to the latest software and it just plug and plays. It doesn't work with any other iPod, but will soon have capability to work with the iPod Touch and the iPhone. Check the link below to the Nike + website for more up-to-date information.

To get voice control on your iPod touch you need to have the 3.0 software or later (for any generation of iPod Touch). You must also have an external microphone for the 1st and 2nd generation iPod Touches, since the 1st and 2nd generations do not have built-in microphones.
