Sasuke didn't actually kill Orochimaru. After a short, one sided battle between the two, Orochimaru tried to take Sasuke's body using the Fushi Tensei or in English the Living Corpse Reincarnation and gain the Sharingan. The techinque was reversed by Sasuke with the sharingan and orochimaru was sealed inside. Later on, during Sasuke's fight with Itachi, Sasuke used so much chakra that Orochimaru was able to escape. Itachi used Susanoo to seal him forever.

And in the latest attempt, Itachi dies before he could do any real harm to Sasuke though he never really intended to kill his little brother in the first place.
