In 1857, a slave who had sued his owner for freedom, based on being held a slave in a free state, was soundly defeated based on a Supreme Court ruling, because according to Justice Roger Taney, no black whether they were free or a slave was a citizen of the United States, and therefore, couldn't sue. Abolitionists were incensed by the ruling. The decision increased sectionalism and led to the Civil War.
It increased sectional division because it allowed slaveholders to bring slaves anywhere in the US thereby voiding the Missouri Compromise. The ruling of the Dred Scott case held that slaves were not US citizens.
The Supreme Court ruling in Dred Scott v. Sandford (1857) held that African Americans, whether enslaved or free, were not considered United States citizens and therefore could not sue in federal court. This decision intensified sectional conflict by reinforcing the divide between slave states and free states, fueling tensions over the expansion of slavery into new territories. The ruling was seen as a victory for pro-slavery advocates and a setback for those seeking to abolish slavery, further polarizing the nation on the issue.
The Supreme Court ruling in Dred Scott v. Sandford 1857 worsened sectional conflict by declaring that African Americans, whether enslaved or free, were not citizens and could not sue in the federal courts. This decision further entrenched divisions between the North and South over the issue of slavery and fed into the growing tensions that eventually led to the Civil War.
The federal ruling system is considered more democratic because of the division of power, and the various checks and balances put in place.
According to the official ruling, the HSIAHS (Hide and Seek International Association of Hiding and Seeking) the champion of the Birkenhead division was Sam Bowler, because he was the best hider in all of the land
The Dred Scott ruling did not move the country closer to ending slavery. It astonished the Abolitionists by invoking the original terms of the Constitution - that a man's property was sacred, and that slaves were property. It widened the division.
Typically, a judge in family court does not have the authority to reverse a ruling made in civil court. Family court has its own jurisdiction over specific family-related matters such as divorce, child custody, and support. If a ruling has been made in civil court, it would generally have to be appealed to a higher court rather than being reversed by a judge in family court.
The Hearing Master's recommendations carry great weight but a judge does NOT have to accept the ruling or recommendation of the Master.
